Tripvito makes no express or implied representations or warranties to you or any other person or entity regarding the accuracy, results, timeliness, completeness, merchantability, or fitness for any specific purpose of the Site or any related contents, products, services, or information. We and/or our providers or distributors will not be liable for any damages to, or viruses that may infect, your computer equipment or other property as a result of your access to, use of, or browsing on the Site, or your downloading of any materials, data, text, images, video, audio, or other information from the Site, under any circumstances, including, but not limited to, negligence.
In no event shall we, or our providers or distributors, be liable for any injury, loss, claim, damage, or any special, punitive, indirect, incidental, or consequential damages of any kind (including, but not limited to, lost profits or lost savings), whether based in contract, tort, strict liability, or otherwise, arising out of or in any way connected with the use, or inability to use, the Site or the services or materials on the Site, even if advised of the possibility of such damages In no event shall our aggregate liability, or the liability of our providers or distributors, exceed the total charges specified in the itinerary giving rise to such obligation. Any claim or cause of action arising from or pertaining to your access and use of the Site, or purchase of items and/or services from the Site, must be brought within one (1) year of the date of the claim or cause of action.
Because applicable law may not permit the limitation or exclusion of liability for incidental or consequential damages, the foregoing limitation or exclusion may not apply to you. The use of the Site is entirely at your own risk. By marketing, selling, or taking reservations or bookings for travel-related items and/or services, we are acting as a middleman or agent for suppliers of such products and/or services (such as air and ground transportation, HOTEL ACCOMMODATIONS, meals, tours, cruises, travel insurance, etc.).
All Users agree to defend and indemnify Tripvito, its affiliates, and/or their respective suppliers, as well as any of their officers, directors, employees, and agents, against any and all claims, causes of action, demands, recoveries, losses, damages, fines, penalties, or other costs or expenses of any kind or nature, including but not limited to reasonable legal and accounting fees, brought by:
in excess of the liability described above; or by third parties as a result of your breach of these Terms and Conditions, notices, or documents referenced on the Site; your violation of any law or the rights of a third party; or your use of the Site.
If you have a dispute with a travel service supplier, including but not limited to airlines, HOTELS, cruise lines, railroads, car rental agencies, tour operators, and consolidators to perform the services offered by such suppliers, you release us (and our officers, directors, agents, subsidiaries, joint ventures, and employees) from any and all claims, demands, and damages (actual and consequential) arising out of or in any way connected with the dispute.
You undertake to use the Site's travel services reservations capabilities only to make valid bookings or purchases for yourself or another person for whom you are legally authorised to act. You acknowledge that if you overuse or abuse the Site's travel services reservation facilities, you may be denied access to such facilities. You may not use this Site for any commercial purpose. You agree you will not access, monitor or copy any content or information of this Site using any robot, spider, scraper or other automated means or any manual process for any purpose without our written permission. You agree that you will not violate the restrictions in any robot exclusion headers on this Site, or bypass or circumvent other measures employed to prevent or limit access to this Site.
You undertake not to violate the limits in any robot exclusion headers on this Site, nor will you bypass or circumvent other mechanisms used to prohibit or limit access to this Site. You agree not to alter, duplicate, distribute, transmit, display, perform, reproduce, licence, create derivative works from, transfer, or sell or resell any information, content, graphics, software, goods, or services obtained from or through this Site or call centre. You shall not attempt to gain unauthorised access to the Site, the server on which the Site is hosted, or any server, computer, or database that is linked to the Site.
You shall not launch a denial-of-service or distributed denial-of-service attack against the Site. We will not be liable for any loss or damage resulting from a distributed denial-of-service attack, viruses, or other technologically harmful material that may infect your computer equipment, computer programmes, data, or other proprietary material as a result of your use of the Site or your downloading of any material posted on it or any website linked to it.
If you violate any of the foregoing prohibitions, we retain the right to cancel your Tripvito account and terminate your usage of the Site.
All adjustments to the itinerary are restricted and subject to airline pricing laws, whichever is more restrictive; majority of our tickets, hotels/cars/packages/cruises do not allow any date or name changes after the booking is done. Tripvito does not guarantee and is not liable for any bookings or reservations made or confirmed to you if the original itinerary is amended by the provider at the customer's request.
Tripvito's failure to enforce any aspect of these Terms and Conditions shall not be construed as a waiver of any of Tripvito's rights under these Terms and Conditions, whether for past or future conduct by any individual. Tripvito's receipt of funds, or any person's reliance on Tripvito's conduct, shall not be deemed a waiver of any part of these Terms and Conditions. Only a particular, written waiver signed by an authorised representative of Tripvito will be legally binding.
Please read our Privacy Statement, which also governs this Program. The Tripvito Privacy Policy will explain how we use and protect your personal information. If you do not want your information transferred or used in this manner, please do not use our services.
If there is a change in the price of air fare or any other change prior to your form of payment being processed and accepted successfully, you may be told of this change, and only upon such notification do you have the ability to accept or deny this transaction. You will not be charged if you choose to decline this transaction.
Our Post Payment Price Guarantee: If your payment (credit/debit card) is accepted and processed successfully, we guarantee that we will honour the whole final quoted price of the airline tickets, regardless of any changes or fluctuations in the price of air fare.
If your credit card is declined while we are processing your transaction, we will make every effort to tell you through email within 3 business days. If your credit card has been denied, the purchase will be cancelled. The FARE and other BOOKING DETAILS ARE NOT GUARANTEED. If the fare changes, you have the right to cancel the reservation at no cost to you. There will be no service fees associated with this.
We reserve the right, at our sole discretion and without liability, to cancel your access to all or part of the Site, with or without notice, for any or no reason.
